DSGVO - data protection or not - your app is ready.
The new GDPR, which applies throughout Europe, brings about several changes that must be taken into account as you continue to use our services. Over the past few weeks, we have been working feverishly to integrate these changes with as little additional work for you as possible.
The fact is that you shouldn’t panic, because—despite all the announcements—the new legislation, by definition, does not allow for any wave of warning letters. Furthermore, the changes currently being implemented will only be confirmed in the future through relevant court rulings or established practices. Therefore, appropriate and secure procedures (best practices) will only emerge in the future.
But now to the following changes. These have been published and are already available.
- Our Terms of Use will be updated in accordance with the new requirements.
- A Data Processing Agreement (DPA) supplement required for you (formerly known as an ADV contract, where ADV stands for “Auftragsdatenverarbeitung”) will be provided electronically. A handwritten version is no longer required.
- The Data Processing Addendum is firmly linked to your acceptance of the Terms and Conditions and thus automatically becomes legally valid. No further action is required on your part at this time.
- If needed, and depending on your company-wide policies, you may optionally request a separately electronically signed Data Processing Agreement addendum from us.
- The previous data protection regulations will also be updated and made available in a new version.
The following changes apply to you as a result of using the product and, consequently, the provision of your app(s):
- All existing legal notice information that you have previously provided will now be displayed more prominently under the same heading in the upper right corner of the app.
- In addition, there is a comprehensive and standardized privacy policy that legally ensures the processing of your data with regard to us as a data processor and covers many conceivable scenarios.
- All input fields—such as forms, appointment scheduling, surveys, and contact request fields—can include a link to this policy if necessary.
The changes listed here are necessary measures that we can implement for you within the scope of our technical capabilities. While these do not constitute legal advice, they also unfortunately do not exempt you from other GDPR measures that you must implement within your company.
We hope this has been helpful, and we welcome any feedback or additional suggestions.
